Repetro tax benefits: Importing and industrialization incentives

Repetro-industrialization is a customs tax incentive that enables the import and industrialization of products intended for the exploration, development and production of oil, natural gas and other hydrocarbonetal fluids. The companies accredited in Repetro are authorized to import or buy a wide variety of raw materials, intermediate products and packaging materials without the collection of federal taxes and, in some cases, state. These materials are intended entirely for the production of final items aimed at the essential energy supply activities.

In addition, it is important to emphasize that repetition-industrialization can also be used beyond final goods, including apparatus, parts and parts that are directly incorporated into the main equipment to ensure their operation. This covers not only the elements used in production, but also the essential tools for the maintenance and continuous functioning of these assets.

In the internal and interstate import operations mentioned above, the acquirers are responsible for collecting the tax due to permanent goods or goods subject to the differentiated treatment of repetro-SPED. This treatment aims to establish a 3%tax burden, without appropriation of the corresponding credit, in the state where the economic use of these goods or goods occurs.

Companies wishing to join the tax incentive of repetition-industrialization at the federal level and repetro-Sped must meet some requirements. This includes being previously registered in the register of state tax taxpayers, as well as obtaining qualification in the Brazilian IRS for the corresponding tax regime and being framed in the specific hypotheses provided for in the relevant state agreements.

In addition, it is essential that companies have a negative certificate of debts with the State Public Treasury and are manufacturers of final products intended for direct supply to qualified legal entities in special customs regimes related to oil and natural gas activities. Alternatively, companies can be manufacturers of intermediate goods for these same activities.

Beneficiaries of the regime can import or purchase raw materials, intermediate products and packaging materials without the payment of federal taxes such as PIS/Pasep, Cofins, PIS/Pasep-Import and Cofins-Import contribution. >

In addition, they are exempt from Import Tax and IPI at the time of the sale of end products to the beneficiaries of Repetro.

State tax deferral:

The regime implies the deferral of the State Tax on Goods in internal and interstate operations.

Manufacturers of final and intermediate goods, qualified in Repetro, can perform operations with goods and goods intended for the exploration, development and production of oil and natural gas without the immediate payment of state taxes.
